(Watson)  Criminal Justice  5/8/2009  Engrossed     AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   H.B. 2168 amends current law relating to the powers of a sheriff's department civil service commission in certain counties regarding an appeal of a disciplinary action.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 158.035, Local Government Code, by adding Subsection (d), as follows:   (d) Authorizes the sheriff's department civil service commission (commission), in rendering a final decision regarding a disciplinary action by the sheriff's department, to only sustain, overturn, or reduce the disciplinary action. Prohibits the commission from enhancing a disciplinary action by the sheriff's department.    SECTION 2. Makes application of this Act prospective.   SECTION 3. Effective date: September 1, 2009.

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 158.035, Local Government Code, by adding Subsection (d), as follows:
