 A BILL TO BE ENTITLED
 AN ACT
 relating to suspension or cancellation of certain alcoholic
 beverage permits for nonpayment of accounts.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter C, Chapter 11, Alcoholic Beverage
 Code, is amended by adding Section 11.614 to read as follows:
 Sec. 11.614.  SUSPENSION OR CANCELLATION FOR NONPAYMENT OF
 ACCOUNT. (a)  Subject to Subsection (b), the commission may, after
 notice and hearing, cancel or suspend a wholesaler's, general class
 B wholesaler's, or local class B wholesaler's permit on proof that
 the permit holder, after reasonable opportunity to do so, failed to
 make a timely and sufficient payment for a product purchased from
 the holder of a nonresident seller's, nonresident brewer's,
 brewer's, or distiller's and rectifier's permit.
 (b)  The commission may cancel or suspend a permit under this
 section only after receipt of a complaint by the permit holder to
 whom payment is owed.
 SECTION 2. The change in law made by this Act applies only
 to payment for a product purchased on or after the effective date of
 this Act. Payment for a product purchased before the effective date
 of this Act is governed by the law in effect immediately before that
 date, and that law is continued in effect for that purpose.
 SECTION 3. This Act takes effect September 1, 2009.
