BILL ANALYSIS Senate Research Center H.B. 2219 By: Phillips (Williams) Transportation & Homeland Security 5/8/2009 Engrossed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT H.B. 2219 requires a public transportation advisory committee consisting of nine members, rather than 11 members, to reflect the diversity of the state. The bill also provides that a member serves at the pleasure of the officer who appointed the member. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 455.004(a), (b), and (c), Transportation Code, as follows: (a) Requires a public transportation advisory committee consisting of nine members, rather than 11 members, to reflect the diversity of the state. Makes nonsubstantive changes. (b) Requires the members of the committee to be appointed by the governor, the lieutenant governor, and the speaker of the house of representatives, who are required to each appoint one member who represents a diverse cross-section of public transportation providers, one member who represents a diverse cross-section of transportation users, and one member who represents the general public. Deletes existing text requiring the Texas Transportation Commission (TTC) to appoint the members of the advisory committee and requiring the membership of the committee to include four members who represent a diverse cross-section of public transportation providers, three members who represent a diverse cross-section of transportation users, three members who represent the general public, and one member with experience in the administration of health and human services programs. (c) Provides that a member serves at the pleasure of the officer who appointed the member, rather than at the pleasure of TTC. SECTION 2. Provides that the change in law made by this Act to the public transportation advisory committee does not affect the entitlement of a member serving on the committee immediately before the effective date of this Act to serve the remainder of the member's term. Prohibits the first two members whose positions expire or become vacant from being replaced. SECTION 3. Effective date: September 1, 2009.
