Kolkhorst, Chair, House Committee on Public Health      FROM: John S. O'Brien, Director, Legislative Budget Board     IN RE:HB2369 by Flynn (Relating to the sale of a cemetery plot; providing a criminal penalty.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would amend the Health and Safety Code relating to cemetery sales and brokers. The Department of Banking (DOB) would be required to provide model quitclaim agreements, register cemetery brokers, and provide the public with information relating to the resale of cemetery plots and complaint filing. Additionally, the commissioner would be able to revoke the registration of a cemetery broker for reasons outlined in the bill.   Based on the analysis of DOB, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
