 A BILL TO BE ENTITLED
 AN ACT
 relating to the provision of home health services under the
 Medicaid program in accordance with authorization by a licensed
 nurse practitioner or a physician assistant.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 32.067, Human Resources Code, is amended
 by adding Subsection (c) to read as follows:
 (c)  The department shall assure that a licensed nurse
 practitioner or a physician assistant is permitted to authorize the
 provision of home health services to individuals enrolled in the
 Texas Health Steps Comprehensive Care Program, to the extent that a
 nurse practitioner or physician assistant is permitted to authorize
 those services under Chapter 142, Health and Safety Code.
 SECTION 2. If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3. This Act takes effect September 1, 2009.
