 A BILL TO BE ENTITLED
 AN ACT
 relating to consumer goods and services covered under the Texas
 Telemarketing Disclosure and Privacy Act.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 304.002(3), Business & Commerce Code, as
 effective April 1, 2009, is amended to read as follows:
 (3) "Consumer good or service" means property of any
 kind or a contractual service that is normally used for personal,
 family, or household purposes. The term:
 (A) does not include a security, as defined by
 Section 4, The Securities Act (Article 581-4, Vernon's Texas Civil
 Statutes); and
 (B)  includes the extension of a warranty for a
 motor vehicle.
 SECTION 2. The change in law made by this Act applies only
 to a call made on or after the effective date of this Act. A call
 made before the effective date of this Act is governed by the law in
 effect when the call was made, and the former law is continued in
 effect for that purpose.
 SECTION 3. This Act takes effect September 1, 2009.
