O'Brien, Director, Legislative Budget Board     IN RE:HB2826 by Naishtat (Relating to the Texas Commission on Environmental Quality and retailer responsibility regarding recycling of computer equipment.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would provide criteria for retailers of computer equipment to be considered in compliance with recovery plan requirements. A retailer would be considered in compliance if on the date the equipment is ordered from a manufacturer or agent the manufacturer is included on the Texas Commission on Environmental Quality (TCEQ)'s internet site as a manufacturer with a compliant recovery plan. The bill would require the TCEQ to keep historical records of the list of computer manufacturers with recovery plans retrievable by date. The bill also would require retailers to provide consumers with TCEQ information on how to recycle computer equipment. In addition, the bill would require the TCEQ to remove computer manufacturers not in compliance with computer-equipment recycling law from the TCEQ's on-line list on a quarterly basis. Any costs associated with the implementation of the bill are expected to be absorbed using current TCEQ resources.
