BILL ANALYSIS H.B. 3106 By: Madden Corrections Committee Report (Unamended) BACKGROUND AND PURPOSE Certain state employees and many staff of the Texas Department of Criminal Justice (TDCJ) receive hazardous duty pay in addition to their base salary because of the nature of their job assignments. H.B. 2498, 80th Legislature, Regular Session, 2007, increased the rate of hazardous duty pay for correctional security staff from $10 each month to $12 each month for each 12-month period of lifetime service accrued. Other TDCJ employees authorized to receive hazardous duty pay, such as parole officers and staff in agriculture, industry, and maintenance positions, continue to receive $10 per month for each 12-month period of lifetime service accrued. H.B. 3106 increases the rate of hazardous duty pay for TDCJ employees who are eligible for hazardous duty pay but ineligible for the increased rate authorized by H.B. 2498, 80th Legislature, Regular Session, 2007. H.B. 3106 makes all TDCJ employees eligible for the same rate of hazardous duty pay. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 3106 amends the Government Code to entitle any full-time state employee employed by the Texas Department of Criminal Justice (TDCJ), rather than only a correctional officer employed by TDCJ, to the following amount of hazardous duty pay for a particular month: the lesser of $12 for each 12-month period of lifetime service credit accrued by the employee or $300.
