O'Brien, Director, Legislative Budget Board     IN RE:HB3280 by Phillips (Relating to the procedure for the removal of a cattle guard on a county road.), Committee Report 1st House, Substituted    No fiscal implication to the State is anticipated.  The bill would amend the Transportation Code to authorize a county commissioners court to remove a cattle guard if the commissioners court notifies each person who owns land adjacent to the cattle guard by certified mail not less than 90 days before the proposed removal. A public hearing would not be required unless an affected resident submits, before the 75th day after the date the notice is mailed by the commissioners court, a written request for a hearing.
