LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION April 1, 2009 TO: Honorable Joseph Pickett, Chair, House Committee on Transportation FROM: John S. O'Brien, Director, Legislative Budget Board IN RE:HB3483 by Coleman (Relating to county authority to prohibit off-premise signs on certain roads and standards for off-premise signs.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend the Transportation Code to require the Texas Transportation Commission to adopt rules related to outdoor advertising in industrial or commercial areas outside the corporate boundaries and extraterritorial jurisdiction of a municipality, including height, size, and placement limitations for outdoor signs in those areas. The bill would allow a prohibition on erecting a sign adjacent to and visible from a public road or portion of a public road outside the corporate boundaries and extraterritorial jurisdiction of a municipality if the road/portion has been designated through an order of the appropriate commissioners court, only after conducting a public hearing on the public order. Based on the analysis of the Texas Department of Transportation, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
