 A BILL TO BE ENTITLED
 AN ACT
 relating to the use of recycled glass in asphalt used by the Texas
 Department of Transportation.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter I, Chapter 201, Transportation Code,
 is amended by adding Section 201.712 to read as follows:
 Sec. 201.712.  REQUIREMENTS FOR ASPHALT IN CERTAIN PROJECTS.
 (a) In this section, "glass cullet" means recycled, crushed glass
 suitable as a replacement for gravel aggregate in roadway
 construction.
 (b)  The department shall use, or enter into a contract to
 use, glass cullet as a replacement for aggregate material so that
 the overall amount of aggregate material replaced statewide in all
 projects subject to this section is 10 percent.
 (c) This section applies to all projects involving:
 (1) an embankment;
 (2) flexible base;
 (3) backfill for a structure;
 (4) a retaining wall; or
 (5) a pipe underdrain.
 (d)  The department shall adopt rules to implement this
 section.
 SECTION 2. (a) Section 201.712, Transportation Code, as
 added by this Act, applies only to a request for bids, proposals, or
 other offers by or on behalf of the Texas Department of
 Transportation that relates to a contract that involves the use of
 asphalt that is published on or after January 1, 2010.
 (b) The department shall adopt rules to implement Section
 201.712, Transportation Code, as added by this Act not later than
 January 1, 2010.
 SECTION 3. This Act takes effect September 1, 2009.
