 A BILL TO BE ENTITLED
 AN ACT
 relating to outdoor lighting on state owned property.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter D, Chapter 2158, Government Code, is
 amended by adding Section 2158.182 to read as follows:
 Sec. 2158.182.  OUTDOOR LIGHTING.  (a)  A state agency may
 not purchase a lighting fixture for outdoor use unless the lamp:
 (1)  achieves an efficiency of no less than 60 lumens
 per watt; and
 (2) has a minimum life expectancy of 50,000 hours.
 (b)  This section applies to outdoor lighting being
 installed or maintained on property owned, operated, maintained, or
 developed by the state.
 (c)  For the purposes of this section lighting of state owned
 parking facilities shall be construed as outdoor use.
 (d)  This Section applies only to the new installation of a
 lamp or to the repair, renovation, or retrofit of a lamp no longer
 properly functioning.
 (e)  An agency may choose to waive the provisions of
 Subsection (a) due to an existing contract if:
 (1)  that contract provided for the installation,
 renovation, repair, or retrofit of outdoor lamp lighting;
 (2) was entered into prior to September 1, 2009; and
 (3)  for which inventory has been purchased or ordered
 prior to September 1, 2009.
 SECTION 2. This Act takes effect September 1, 2009.
