A BILL TO BE ENTITLED
AN ACT
relating to purchasing and contracting authority of
municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Amend Section 252.061 of the Local Government
Code to read as follows:
If the contract is made without compliance with this chapter, it is
void and the performance of the contract, including the payment of
any money under the contract, may be enjoined by any property tax
paying resident of the municipality, or a person or entity that
placed a bid on the public works project, regardless of whether the
bidder is a resident of the municipality.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided in Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
