A BILL TO BE ENTITLED
AN ACT
relating to itemized statements provided by certain health care
facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 324.101, Health and Safety Code, is
amended by adding Subsection (j) to read as follows:
(j) An itemized statement provided as required by this
section must:
(1) include the unit price billed for:
(A) any medical hardware provided by the
facility;
(B) each device or implant provided by the
facility; and
(C) any prescription specialty drug or drug
protocol dispensed by the facility; and
(2) to the extent the unit price reflects a discount,
rebate, or other adjustment to the price paid by the facility, be
accompanied by sufficient documentation to support the unit price
charged.
SECTION 2. Section 324.101, Health and Safety Code, as
amended by this Act, applies only to an itemized statement for
services or supplies provided by a health care facility to a
consumer on or after the effective date of this Act. An itemized
statement for services or supplies provided before the effective
date of this Act is governed by the law in effect immediately before
the effective date of this Act, and that law is continued in effect
for that purpose.
SECTION 3. This Act takes effect September 1, 2009.
