O'Brien, Director, Legislative Budget Board     IN RE:HB39 by Corte (Relating to punishment for the sale of an alcoholic beverage to a minor.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Alcoholic Beverage Code to make the sale of an alcoholic beverage to a minor punishable as a state jail felony if the person has a prior conviction for the offense or for sale of alcoholic beverages to certain persons.  The offense is currently punishable as a Class A misdemeanor. It is assumed that the number of persons convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
