O'Brien, Director, Legislative Budget Board     IN RE:HB3987 by Merritt (Relating to the administration of certain provisions affecting the licensing of persons to carry a concealed handgun.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Government Code to expand the list of offenses under which an entry of deferred adjudication negates conviction.  The bill would also change certain procedures that must be followed by an applicant for a concealed handgun license.  The bill would also allow the Department of Public Safety (DPS) to use a written statement from a qualified handgun instructor as a basis on which to deny a license to an applicant.  The bill would also amend the Education Code to prohibit DPS from issuing or renewing a concealed handgun license for a person who is found to be in default of a student loan.  The bill would appeal Sections 411.175, 411.1882, and 411.189, Government Code.  The bill would take effect September 1, 2009.  This analysis determines that implementing the provisions of the bill would not pose a significant fiscal impact to the state. Local Government Impact No significant fiscal implication to units of local government is anticipated.
