O'Brien, Director, Legislative Budget Board IN RE:HB42 by Corte (Relating to liability for injury arising from a motor vehicle accident.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend the Civil Practice and Remedies Code regarding liability for injury arising from a motor vehicle accident. The bill would require the Department of Public Safety to post a notice at each drivers license office regarding the provisions of the bill. Additionally, the bill would require driving safety courses to provide to students in writing information about this change in liability. The bill requries the Texas Education Agency to adopt the form and content of the notice used by the driving safety courses. The bill would result in the Texas Department of Insurance potentially initiating enforcement actions due to noncomplaince, and could result in rate adjustments. Based on analysis provided by the affected agencies, any costs associated with implementing the provisions of this bill could be absorbed within each agency's existing resources.
