O'Brien, Director, Legislative Budget Board     IN RE:HB4467 by Gallego (Relating to the creation and prosecution of the offense of making a false statement with the intent to deny a benefit.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code by creating the offense of false statement to deny benefits which would be punishable at all offense levels based on the value of the benefit denied.  The bill would also amend the Code of Criminal Procedure to make the limitation period for the newly created offense ten years from the date of the commission of the offense.The bill would take effect September 1, 2009.The number of offenders convicted under the provisions of the bill is not expected to result in increased demands upon the correctional resources of counties or of the State.
