O'Brien, Director, Legislative Budget Board     IN RE:HB453 by Gonzalez Toureilles (Relating to the use of auction proceeds from the sale of certain abandoned motor vehicles to compensate certain property owners.), As Engrossed    No fiscal implication to the State is anticipated.  The bill would add Section 683.015(f) and (g) to the Transportation Code, to allow a county law enforcement agency to use funds from proceeds gained from the sale of a motor vehicle abandoned as a result of a vehicular pursuit involving the law enforcement agency for compensating property owners whose property was damaged as a result of a pursuit, regardless if the agency would be liable under Chapter 101, Civil Practice and Remedies Code. The funds would be those transferred under subsection (d), which are funds transferred by a municipality or a county from general revenue to provide for law enforcement use. The bill stipulates limits on the amount of compensation. Prior to a law enfocement agency compensating a property owner using funds transferred to a county, the sheriff or constable must submit the proposed payment for consideration, and the commissioners court shall consider the proposed payment, at the next regularly scheduled meeting of the county commissioners court.
