A BILL TO BE ENTITLED
AN ACT
relating to the training requirements for surveyors of certain
long-term care facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 22.039, Human Resources Code, is amended
by amending Subsection (b) and adding Subsection (b-1) to read as
follows:
(b) The department shall require a surveyor to complete a
basic training program before the surveyor inspects, surveys, or
investigates a long-term care facility. The training must include
observation of the operations of a long-term care facility
unrelated to the survey, inspection, or investigation process for a
minimum of 10 working days [within a 14-day period].
(b-1) The department shall waive the observation
requirement under Subsection (b) for a surveyor who has been
employed in a long-term care facility within five years of the date
the person assumes duties as a surveyor.
SECTION 2. This Act takes effect September 1, 2009.
