A BILL TO BE ENTITLED
AN ACT
relating to the review and adoption cycle for public school
textbooks.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 31.022(a), Education Code, is amended to
read as follows:
(a) The State Board of Education shall adopt a review and
adoption cycle for textbooks for elementary grade levels, including
prekindergarten, and secondary grade levels, for each subject in
the required curriculum under Section 28.002. The cycle shall be
organized to provide for the board to review and adopt electronic
textbooks for a subject before the board reviews and adopts for a
subject any textbook that is not an electronic textbook.
SECTION 2. Section 31.022(a), Education Code, as amended by
this Act, applies only to the public school textbook review and
adoption cycle for a textbook for which the State Board of Education
issues a proclamation under Subchapter B, Chapter 31, Education
Code, on or after the effective date of this Act. The review and
adoption cycle for a textbook for which the State Board of Education
issues a proclamation before the effective date of this Act is
governed by the law in effect when the proclamation was issued, and
the former law is continued in effect for that purpose.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
