A BILL TO BE ENTITLED
AN ACT
relating to an additional fine for the violation of a municipal
rule, ordinance, or police regulation to be used to support
municipal parks.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 54, Local Government Code,
is amended by adding Section 54.007 to read as follows:
Sec. 54.007. ADDITIONAL FINE TO SUPPORT MUNICIPAL PARKS.
(a) A municipality shall assess an additional fine for each
violation of a municipal rule, ordinance, or police regulation in
an amount of 10 percent of the fine originally assessed, but not
less than $10.
(b) The additional fine must be used to support municipal
parks.
SECTION 2. The change in law made by this Act applies only
to a violation committed on or after the effective date of this Act.
A violation committed before the effective date of this Act is
governed by the law in effect when the violation was committed, and
the former law is continued in effect for that purpose. For
purposes of this section, a violation was committed before the
effective date of this Act if any element of the violation occurred
before that date.
SECTION 3. This Act takes effect September 1, 2009.
