(Hinojosa)  Jurisprudence   5/22/2009  Engrossed     AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   According to the most current Office of Court Administration data, there were 29,196 pending cases in the county courts of Hidalgo County. While many counties of comparable population saw a decrease in the number of pending cases from January 2007 to January 2009, Hidalgo County realized an increase of more than five percent to the courts' pending caseload. In order to address the number of cases in the Hidalgo County court system, this bill creates two additional county courts at law in Hidalgo County.    H.B. 4793 relates to the creation of two additional county courts at law in Hidalgo County.    RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 25.1101(a), Government Code, to provide that Hidalgo County has certain statutory county courts, including County Court at Law No. 7 of Hidalgo County and County Court at Law No. 8 of Hidalgo County. Makes nonsubstantive changes.    SECTION 2. (a) Provides that the County Court at Law No. 7 of Hidalgo County is created on the effective date of this Act.   (b) Provides that notwithstanding Section 25.1101(a)(7) (relating to the County Court at Law No. 8 of Hidalgo County), Government Code, as added by this Act, the County Court at Law No. 8 of Hidalgo County is created on September 1, 2012.   SECTION 3. Effective date: September 1, 2011.

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 25.1101(a), Government Code, to provide that Hidalgo County has certain statutory county courts, including County Court at Law No. 7 of Hidalgo County and County Court at Law No. 8 of Hidalgo County. Makes nonsubstantive changes. 

 

SECTION 2. (a) Provides that the County Court at Law No. 7 of Hidalgo County is created on the effective date of this Act.

 

(b) Provides that notwithstanding Section 25.1101(a)(7) (relating to the County Court at Law No. 8 of Hidalgo County), Government Code, as added by this Act, the County Court at Law No. 8 of Hidalgo County is created on September 1, 2012.

 

SECTION 3. Effective date: September 1, 2011.
