A BILL TO BE ENTITLED
AN ACT
relating to the counting of a provisional ballot cast by a voter in
a precinct in which the voter does not reside.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 65.054, Election Code, is amended by
adding Subsection (e) to read as follows:
(e) For a provisional ballot cast outside the precinct in
which a voter resides, the board shall accept the ballot of a voter
who is registered to vote in this state but only count a vote cast
for:
(1) an office or proposition stating a measure for
which a statewide election was held; and
(2) an office or proposition stating a measure in a
territorial unit of which the voter was entitled to vote at the
voter's registered address.
SECTION 2. This Act takes effect September 1, 2009.
