 A BILL TO BE ENTITLED
 AN ACT
 relating to the abolition of the Texas Incentive and Productivity
 Commission and the state employee incentive program.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. AMENDMENT. The heading to Chapter 2108,
 Government Code, is amended to read as follows:
 CHAPTER 2108. SAVINGS [EMPLOYEE] INCENTIVE PROGRAM FOR STATE [AND]
 AGENCY [PRODUCTIVITY]
 SECTION 2. REPEALER. (a) Subchapters A and B, Chapter
 2108, Government Code, are repealed.
 (b) The subchapter heading to Subchapter C, Chapter 2108,
 Government Code, is repealed.
 SECTION 3. CONFORMING AMENDMENT. Section 2113.107(f),
 Government Code, is amended to read as follows:
 (f) Subsection (e) does not apply to the publication of a
 brochure regarding approved foods under the federal special
 supplemental food program for women, infants, and children
 administered by the Texas Department of Health, a publication
 designed to promote tourism or economic development, a publication
 of the Texas School for the Deaf or the Texas School for the Blind
 and Visually Impaired, [a publication of the Texas Incentive and
 Productivity Commission,] or a publication of an institution of
 higher education.
 SECTION 4. CONFORMING REPEALERS. The following laws are
 repealed:
 (1) Section 201.0192, Agriculture Code;

 (5) Section 14.067, Finance Code;

 SECTION 5. ABOLITION. On the effective date of this Act:
 (1) the Texas Incentive and Productivity Commission is
 abolished;
 (2) all commission employee positions are eliminated;
 (3) the state employee incentive program under
 Subchapter B, Chapter 2108, Government Code, is abolished; and
 (4) any memorandum of understanding or interagency
 contract entered into between the Texas Incentive and Productivity
 Commission and another state agency expires.
 SECTION 6. EFFECTIVE DATE. This Act takes effect
 immediately if it receives a vote of two-thirds of all the members
 elected to each house, as provided by Section 39, Article III, Texas
 Constitution. If this Act does not receive the vote necessary for
 immediate effect, this Act takes effect September 1, 2009.
