O'Brien, Director, Legislative Budget Board IN RE:HB941 by Dutton (Relating to the determination that certain criminal offenses involve family violence.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend the Code of Criminal Procedure relating to the determination that certain criminal offenses involve family violence. According to the Office of Court Administration, the bill would provide that the jury (and not just the judge) may determine whether an offense involves family violence. To the extent the bill would modify judicial proceedings, no increase in judicial workloads or fiscal implication to the State is anticipated. The bill would take effect September 1, 2009. Local Government Impact No significant fiscal implication to units of local government is anticipated.
