O'Brien, Director, Legislative Budget Board IN RE:SB1044 by Gallegos (Relating to the hours for the wholesale delivery or sale of alcoholic beverages.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend the Alcoholic Beverage Code, Section 105.02 to allow wholesalers and holders of a local distributors permit to sell, offer for sale, or deliver liquor to a retailer at anytime except Sunday or Christmas Day. The bill would also amend Section 105.051 to expand the hours holders of certain distributors licenses are able to sell, offer for sale, or deliver beer. The bill would also repeal Section 105.052, Alcoholic Beverage Code relating to the hours of sale of beer by holders of certain distributors licenses in certain metropolitan areas. The bill would take effect immediately if it receives a two-thirds vote of all the members in each house, otherwise it would take effect on September 1, 2009. The Texas Alcoholic Beverage Commission (TABC) and the Comptroller of Public Accounts (CPA) anticipate no significant fiscal impact to their agencies or the State.
