The bill would re-enact Subsection (a) of Section 150.002 of the Civil Practice and Remedies Code, and would add Subsection (a-1). The bill would require an affidavit of a third-party licensed architect, registered professional land surveyor, or licensed professional engineer to be filed in actions and arbitrations alleging professional negligence by a licensed or registered professional. The bill would take effect September 1, 2009. Local Government Impact No significant fiscal implication to units of local government is anticipated.
