A BILL TO BE ENTITLED
AN ACT
relating to the placement of certain children who are in the
managing conservatorship of the state.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 262.114, Family Code, is amended by
adding Subsection (c) to read as follows:
(c) The department shall consider placing a child who has
previously been in the managing conservatorship of the department
with a foster parent with whom the child previously resided if:
(1) the department determines that placement of the
child with a relative or designated caregiver is not in the child's
best interest; and
(2) the placement is available and in the child's best
interest.
SECTION 2. This Act takes effect September 1, 2009.
