A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain counties to construct,
acquire, improve, operate, or maintain causeways, bridges,
tunnels, turnpikes, ferries, and highways.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 284.002(a), Transportation Code, is
amended to read as follows:
(a) Except as provided by Subsection (b), this chapter
applies only to a county that:
(1) has a population of 50,000 or more and borders the
Gulf of Mexico or a bay or inlet opening into the gulf;
(2) has a population of 1.5 million or more;
(3) is adjacent to a county that has a population of
3.4 [1.5] million or more; or
(4) borders the United Mexican States.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
