O'Brien, Director, Legislative Budget Board IN RE:SB1426 by Williams (Relating to the installation, operation, and maintenance of automatic license plate identification cameras on a highway; providing for the imposition of criminal penalties.), Committee Report 2nd House, Substituted No significant fiscal implication to the State is anticipated. The bill would amend the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to enter into an agreement with the Department of Public Safety (DPS), a federal law enforcement agency, or a local law enforcement agency operating an automatic license plate identification camera (camera) under the authority of a federal law enforcement agency that authorizes a program to install, maintain, and operate a camera on state highway rights-of-way. The bill would prescribe general terms for such an agreement and purposes for which images produced by the camera may be used. The bill would create as a Class C misdemeanor offense the act of using an automatic license plate identification camera other than in the manner and for the purpose specified by the provisions of the bill. A Class C misdemeanor is punishable by a fine not to exceed $500. Based on the analysis of TxDOT and DPS, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources.
