 A BILL TO BE ENTITLED
 AN ACT
 relating to exemptions from certain mandated benefit requirements
 in supplemental or limited coverage health benefit plans.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subtitle G, Title 8, Insurance Code, is amended
 by adding Chapter 1509 to read as follows:
 CHAPTER 1509. SUPPLEMENTAL OR LIMITED COVERAGE PLANS
 Sec. 1509.001.  DEFINITION. In this chapter, "supplemental
 or limited coverage plan" means a dental plan, a vision plan, an
 accident-only plan, a limited benefits plan, and other supplemental
 insurance policies as designated by the commissioner.
 Sec. 1509.002.  EXEMPTION. A supplemental or limited
 coverage plan is not required to provide coverage for a
 state-mandated benefit, as that term is used by Chapter 1507.
 SECTION 2. This Act applies only to an insurance policy or
 contract or evidence of coverage that is delivered, issued for
 delivery, or renewed on or after January 1, 2010. An insurance
 policy or contract or evidence of coverage delivered, issued for
 delivery, or renewed before January 1, 2010, is governed by the law
 as it existed immediately before the effective date of this Act, and
 that law is continued in effect for that purpose.
 SECTION 3. This Act takes effect September 1, 2009.
