 A BILL TO BE ENTITLED
 AN ACT
 relating to motor vehicles; providing penalties.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 501.002(1), Transportation Code, is
 amended to read as follows:
 (1) "Certificate of title" means a printed record of
 title [an instrument] issued under Section 501.021.
 SECTION 2. Section 502.001(1), Transportation Code, is
 amended to read as follows:
 (1) "All-terrain vehicle" means a motor vehicle that
 is:
 (A) equipped with a saddle, bench, or bucket
 seats for the use of:
 (i) the rider; and
 (ii) a passenger, if the motor vehicle is
 designed by the manufacturer to transport a passenger;
 (B) designed to propel itself with three or more
 tires in contact with the ground; and
 (C) designed by the manufacturer for off-highway
 use [; and
 [(D)     not designed by the manufacturer primarily
 for farming or lawn care].
 SECTION 3. Subchapter A, Chapter 520, Transportation Code,
 is amended by adding Section 520.003 to read as follows:
 Sec. 520.003.  RULES. The department may adopt rules to
 administer this chapter.
 SECTION 4. Section 520.036, Transportation Code, is
 transferred to Subchapter B, Chapter 520, Transportation Code, and
 renumbered as Section 520.026, Transportation Code, to read as
 follows:
 Sec. 520.026 [520.036]. GENERAL PENALTY. (a) A person
 commits an offense if the person violates this subchapter in a
 manner for which a specific penalty is not provided.
 (b) An offense under this section is a misdemeanor
 punishable by a fine of not less than $50 and not more than $200.
 SECTION 5. (a) The change in law made by this Act applies
 only to an offense committed on or after September 1, 2009.
 (b) An offense committed before September 1, 2009, is
 covered by the law in effect when the offense was committed, and the
 former law is continued in effect for that purpose. For purposes of
 this subsection, an offense was committed before September 1, 2009,
 if any element of the offense was committed before that date.
 SECTION 6. This Act takes effect September 1, 2009.
