 A BILL TO BE ENTITLED
 AN ACT
 relating to lapsed teacher certification due to a delay in agency
 processing.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subsections (a) and (e), Section 21.0031,
 Education Code, are amended to read as follows:
 (a) An employee's probationary, continuing, or term
 contract under this chapter is void if the employee[:
 [(1)] does not hold a certificate or permit issued by the
 State Board for Educator Certification[; or
 [(2)     fails to fulfill the requirements necessary to extend
 the employee's temporary or emergency certificate or permit].
 (e) This section does not apply to a certified teacher
 assigned to teach a subject for which the teacher is not certified
 or to an employee who has held a standard certificate, permit, or
 other type of certification under this chapter that requires
 renewal and who has timely fulfilled the requirements necessary for
 renewal, notwithstanding any delay in processing the renewal that
 is not within the control of the employee.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
