LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION April 17, 2009 TO: Honorable John Whitmire, Chair, Senate Committee on Criminal Justice FROM: John S. O'Brien, Director, Legislative Budget Board IN RE:SB1652 by Duncan (Relating to the transfer of certain state property from the Texas Department of Criminal Justice to Mitchell County.), As Introduced No significant fiscal implication to the State is anticipated. The bill would require the Department of Criminal Justice (TDCJ) to transfer specified property to Mitchell County for a purpose that benefits the public interest of the state. If after the transfer, the property is not used for a purpose that benefits the public interest of the state, ownership of the property would automatically revert to TDCJ. TDCJ would be required to transfer the property by an appropriate instrument of transfer. Mitchell County would be required to pay any transaction fees resulting from the transfer of the property. Local Government Impact Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
