 A BILL TO BE ENTITLED
 AN ACT
 relating to the allocation of certain constitutionally dedicated
 funds to the Lamar Institute of Technology.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 62.021, Education Code, is amended by
 adding Subsection (a-1) to read as follows:
 (a-1)  Notwithstanding Subsection (a), for each year
 remaining in the 10-year allocation period established under
 Section 17(d), Article VII, Texas Constitution, that ends in 2015,
 the comptroller shall distribute to the Lamar Institute of
 Technology in accordance with the allocation formula described by
 Subsection (a) a portion of the total annual appropriation under
 Section 17(a), Article VII, Texas Constitution, otherwise
 allocated under Subsection (a).  The comptroller shall adjust the
 distributions made to other eligible institutions under the
 equitable formula as necessary to reflect the inclusion of the
 Lamar Institute of Technology in the agencies and institutions
 participating in the allocation of the annual appropriation under
 Section 17(a), Article VII, Texas Constitution.  This subsection
 expires January 1, 2016.
 SECTION 2. This Act takes effect January 1, 2010, but only
 if the constitutional amendment proposed by the 81st Legislature,
 Regular Session, 2009, to allow the Lamar Institute of Technology
 to participate in the allocation of certain constitutionally
 dedicated funds for capital improvements at agencies and
 institutions of higher education is approved by the voters. If that
 constitutional amendment is not approved by the voters, this Act
 does not take effect.
