The bill would amend Section 43.0754 of the Local Government Code to clarify the definition of "party" that is able to participate in a regional participation agreement. The bill also would add Subsection (q) to Section 43.0754 of the Local Government Code, which states that governmental immunity from suit of party to a regional participation agreement is waived for the limited purpose of a cause of action brought by a party based on or arising out of a regional participation agreement. Local Government Impact Costs to entities participating in a regional participation agreement would depend on the number of causes of action that may be brought by a party.
