BILL ANALYSIS Senate Research Center S.B. 2058 By: Williams Transportation & Homeland Security 4/4/2009 As Filed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT As proposed, this bill provides that the Harris County Road Law, an Act of the 33rd Legislature, Regular Session, 1913, prevails when in conflict with general law over any provision of general law that is in conflict or inconsistent with this Act. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 33, Chapter 17, Special Laws, Acts of the 33rd Legislature, Regular Session, 1913, as follows: Sec. 33. Provides that the provisions of this Act are, and are required to be held and construed to be cumulative of all General Laws of this State, on the subjects treated of in this Act, rather than are, and are required to be held and construed to be cumulative of all General Laws of this State, on the subjects treated of in this Act, when not in conflict. Provides that this Act and the rules promulgated pursuant to this Act control over any provision of general law that is in conflict or inconsistent with this Act. SECTION 2. Effective date: upon passage or September 1, 2009.
