BILL ANALYSIS Senate Research Center S.B. 2067 By: Davis, Wendy State Affairs 9/28/2009 Enrolled AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Currently, state party executive committees are permitted to exempt a county party from the requirement that the location of their county convention be subject to the same accessibility requirements as a polling place. S.B. 2067 amends current law relating to access to precinct conventions by the elderly and persons with physical disabilities. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 174.022(d), Election Code, as follows: (d) Requires that the place selected for a precinct convention meet the same requirements for access by the elderly and persons with physical disabilities as a polling place under Section 43.034(a) (relating to accessibility requirements for polling places). Deletes existing text requiring that the place selected for a precinct convention meet the same requirements for access by the elderly and persons with physical disabilities as a polling place under Section 43.034(a) unless the state executive committee for a political party issues an order that the places for precinct conventions for that political party are not required to meet the same requirements as a polling place under Section 43.034(a), and text requiring that the order be entered in the minutes of the state executive committee not later than the 30th day before the date precinct conventions are to be held. SECTION 2. Effective date: September 1, 2009.
