The bill would clarify language and remove outdated terminology by amending Section 406.009(e) of the Government Code pertaining to the determination of whether there is good cause to deny or formally discipline a notary commission by exempting a dismissal of proceedings against the defendant and discharge of the defendant before an adjudication of guilt and a finding of guilt that has been set aside. The bill would be effective September 1, 2009. Local Government Impact No significant fiscal implication to units of local government is anticipated.
