A BILL TO BE ENTITLED
AN ACT
relating to the disclosure of electricity generation offers
received by ERCOT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
amended by adding Section 39.1516 to read as follows:
Sec. 39.1516. DISCLOSURE OF ELECTRICITY GENERATION OFFERS.
(a) An independent organization certified under Section 39.151
shall disclose all electricity generation offers in the balancing
energy market received by the organization. A disclosure under
this section shall:
(1) be posted on the organization's Internet website
not more than two days after the offer is received; and
(2) include:
(A) the identity of the generation entity making
the offer;
(B) the amount of the offer; and
(C) the location and period for which the offer
is made.
(b) The commission shall adopt rules as necessary to
implement this section.
SECTION 2. This Act takes effect September 1, 2009.
