 A BILL TO BE ENTITLED
 AN ACT
 relating to a fee imposed on foreclosure filings to fund civil legal
 services to indigent Texans.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 118.011, Local Government Code, is
 amended by adding Subsection (h) to read as follows:
 (h) A county clerk shall collect $150 for the filing of the
 first page of a notice filed pursuant to Section 51.002(b)(2) of the
 Property Code. The county clerk shall keep a separate record of the
 money collected under this subsection and shall remit the funds to
 the county treasurer not later than the deadline specified by
 Section 113.022. The county treasurer shall send the money
 received under this subsection to the comptroller not later than
 the last day of the month following each quarter. The comptroller
 shall deposit the money received to the basic civil legal services
 fund of the supreme court.
 SECTION 2. The change in law made by this Act applies only
 to a document presented for filing to a county clerk on or after the
 effective date of this Act. A document presented for filing before
 the effective date of this Act is governed by the law as it existed
 immediately before the effective date of this Act and that law is
 continued in effect for that purpose.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
