BILL ANALYSIS Senate Research Center S.B. 229 By: West Intergovernmental Relations 8/7/2009 Enrolled AUTHOR'S / SPONSOR'S STATEMENT OF INTENT As H.B. 1886 was negotiated last session, a provision phasing in design-build authority for cities with a population between 50,000 and 100,000 was deleted. A drafting error associated with that deletion had the unintended consequence of sunsetting the design-build authority of cities with a population of between 100,000 and 500,000 in 2011. This bill corrects that error. S.B. 229 amends current law relating to the procurement methods authorized for public projects by certain local governments. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 271.182, Local Government Code, as follows: Sec. 271.182. APPLICABILITY. Deletes existing text providing that before September 1, 2009, this subchapter applies to a local governmental entity with a population of 500,000 or more within its geographic boundaries or service area. Provides that this subchapter applies to a local government entity with a population of more than 100,000 within its geographic boundaries or service area, and deletes existing text regarding a two-year period during which this subchapter applies to such an entity. SECTION 2. Effective date: upon passage or September 1, 2009.
