81R8730 KLA-D By: Deuell S.B. No. 2417 A BILL TO BE ENTITLED AN ACT relating to the operation in certain counties of an integrated care management model under the Medicaid managed care program. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter D, Chapter 533, Government Code, is amended by adding Section 533.064 to read as follows: Sec. 533.064. IMPLEMENTATION OF INTEGRATED CARE MANAGEMENT MODEL IN CERTAIN COUNTIES. Notwithstanding Section 533.062, the commission may not contract with an administrative services organization to perform the coordination of care and other services and functions of the integrated care management model developed under Section 533.061, and may not otherwise implement the model, in the Dallas or Tarrant Medicaid service area, as those areas existed on January 1, 2009. SECTION 2. (a) To the extent permitted by law or the terms of the contract, the Health and Human Services Commission shall terminate a contract entered into before the effective date of this Act with an administrative services organization to perform services and functions described by Section 533.062, Government Code, in the Dallas or Tarrant Medicaid service area. (b) On and after the effective date of this Act, the Health and Human Services Commission may not enter into or renew a contract with an administrative services organization to perform services and functions described by Section 533.062, Government Code, in the Dallas or Tarrant Medicaid service area. SECTION 3. If before implementing any provision of this Act a state agency determines that a waiver or authorization from a federal agency is necessary for implementation of that provision, the agency affected by the provision shall request the waiver or authorization and may delay implementing that provision until the waiver or authorization is granted. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2009.
