A BILL TO BE ENTITLED
AN ACT
relating to counties eligible to impose an optional fee on
registration of a vehicle to fund transportation projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 502.1725(a), Transportation Code, is
amended to read as follows:
(a) This section applies only to a county:
(1) that borders the United Mexican States;
(2) that has a population of more than 300,000; and
(3) that either:
(A) has no [in which the largest] municipality
with [has] a population of [less than] 300,000 or more; or
(B) borders another state of the United States.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
