 A BILL TO BE ENTITLED
 AN ACT
 relating to confidentiality of information regarding certain
 agents.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter C, Chapter 552, Government Code, is
 amended by adding Section 552.151 to read as follows:
 Sec. 552.151.  EXCEPTION:  INFORMATION REGARDING SELECT
 AGENTS.  Information that pertains to a biological agent or toxin
 identified or listed as a select agent in federal law,  including
 the Public Health Security and Bioterrorism Preparedness and
 Response Act of 2002, (Public Law 107-188) or regulations
 promulgated under that act, is excepted from the requirements of
 Section 552.021, including information regarding:
 (1) location;
 (2) security protections;
 (3) use or intended use; and
 (4)  the identity of an individual authorized to possess,
 use, or access.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
