O'Brien, Director, Legislative Budget Board     IN RE:SB369 by Carona (Relating to information contained in an intelligence database used to investigate and prosecute offenses committed by criminal street gangs.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure to add to the elements and clarify the combination of elements that must apply when determining criminal information collected in an intelligence database used to investigate and prosecute offenses committed by criminal street gangs. The bill would also change from three to five years the length of time records may be retained before information must be removed. According to the Department of Public Safety, no significant fiscal implication is anticipated.
