O'Brien, Director, Legislative Budget Board IN RE:SB395 by Lucio (Relating to creation of the Early Childhood Health and Nutrition Interagency Council.), As Passed 2nd House No significant fiscal implication to the State is anticipated. The bill would require the Department of Agriculture (TDA) to establish the Early Childhood Health and Nutrition Interagency Council with representatives from TDA, the Health and Human Services Commission, the Department of State Health Services, the Texas Workforce Commission, the Texas Education Agency, the Department of Family and Protective Services and the Texas AgriLife Extension Service. The bill would require TDA to provide staff and resources necessary for the operation of the council. The bill requires the council to review the status of the programs administered by each agency represented on the council that promote healthy nutrition and physical activity in early childhood care settings. The bill would require the council to research various health and nutrition issues for children and develop an early childhood nutrition and physical activity plan to be implemented over a six-year period of time to be submitted to the Legislature and Governor by November 1, 2010. TDA estimates there would be a minimal cost associated with implementing the provisions of the bill. The Central Education Agency, the Department of Family and Protective Services, the Texas Workforce Commission, the Health and Human Services Commission, and the Department of State Health Services indicate that any costs associated with the bill could be absorbed within each agency's existing resources. The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house; otherwise it would take effect September 1, 2009.
