S.B. 461 amends current law relating to eligibility to take the entrance examination for a beginning position in the fire department. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 143.023(a), Local Government Code, as follows: (a) Prohibits a person from taking an entrance examination for a beginning position in the police department, rather than in the fire or police department, unless the person is at least 18 years of age. Prohibits a person from taking an entrance examination for a beginning position in the fire department unless the person is at least 18 years of age but not 36 years of age or older. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: upon passage or September 1, 2009.
