By: Nelson, et al. S.B. No. 492 A BILL TO BE ENTITLED AN ACT relating to the prohibition on certification of sex offenders as emergency medical services personnel. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 773, Health and Safety Code, is amended by adding Section 773.0415 to read as follows: Sec. 773.0415. CERTIFICATION OF SEX OFFENDER PROHIBITED. A person who has been convicted of or placed on deferred adjudication for an offense for which the person is subject to registration under Chapter 62, Code of Criminal Procedure, may not be certified as any type of emergency medical services personnel under this chapter. SECTION 2. (a) The change in law made by this Act applies only to the renewal of an emergency medical technician certificate that expires on or after the effective date of this Act. A certificate that expires before the effective date of this Act is governed by the law in effect on the date the certificate was issued, and the former law is continued in effect for that purpose. (b) The change in law made by this Act applies to an application for an emergency medical technician certificate that is pending on the effective date of this Act or that is filed on or after that date. SECTION 3. This Act takes effect September 1, 2009.
